srpnju ove godine objavljen je <\/span><\/span><a href=\"https:\/\/esavjetovanja.gov.hr\/ECon\/MainScreen?entityId=21184\"><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Prijedlog Zakona o izmjenama i dopunama Zakona o radu<\/span><\/span><\/a><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Najavljene su brojne promjene, a Confida donosi pregled <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">najva\u017enijih. <\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Spomenuli smo, u jednom od <\/span><\/span><a href=\"https:\/\/www.confida.hr\/hr\/rad-na-daljinu\/\"><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">prija\u0161njih tekstova<\/span><\/span><\/a><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">, koliko je zadovoljstvo zaposlenika va\u017eno te kako odre\u0111ene trenutne zakonske odredbe nisu provedene. <\/span><span style=\"vertical-align: inherit;\">S obzirom na to nu\u017eno je prilagoditi zakonsku regulativu.<\/span><\/span><!--more--><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Broj ugovora o radu na odre\u0111eno vrijeme ograni\u010dava se na tri ugovora<\/span><\/span><\/strong><\/h2>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Brojni radnici imali su probleme s konstantnim davanjem ugovora o radu na odre\u0111eno vrijeme. <\/span><span style=\"vertical-align: inherit;\">Vi\u0161e to ne\u0107e biti mogu\u0107e. <\/span><span style=\"vertical-align: inherit;\">Poslodavac \u0107e s radnikom mo\u0107i sklopiti <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">do tri ugovora o radu na odre\u0111eno vrijeme ili aneks ugovora<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> . <\/span><span style=\"vertical-align: inherit;\">Tako\u0111er, <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">pauza<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> izme\u0111u takvih ugovora ne\u0107e vi\u0161e biti dva mjeseca nego <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">\u0161est mjeseci<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> .<\/span><\/span><\/p>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Jo\u0161 jedna va\u017ena stavka je ta da ukoliko poslodavac <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">odbije sklopiti ugovor o radu na neodre\u0111eno vrijeme<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">, a radnik je uspje\u0161no odradio probni rad i radi du\u017ee od \u0161est mjeseci tada \u0107e poslodavac morati <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">pisanim putem obrazlo\u017eiti<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> radniku za\u0161to je donio takvu <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">odluku<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">.<\/span><\/span><\/p>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Ova promjena dovest \u0107e do smanjenja broja radnika koji rade na odre\u0111eno vrijeme te onemogu\u0107iti nepo\u0161tenim poslodavcima da svoje radnike prebacuju iz jedne tvrtke u drugu. <\/span><span style=\"vertical-align: inherit;\">Vi\u0161e ne\u0107e biti opcija da radnici budu nezaposleni dva mjeseca kako bi do\u010dekali da pro\u0111e pauza potrebna za potpisivanje novog ugovora.<\/span><\/span><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Probni rad \u0107e se produ\u017eiti ukoliko radnik bude odsutan<\/span><\/span><\/strong><\/h2>\n<p><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Trajanje probnog rada ostaje isto<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> \u2013 trajat \u0107e najdu\u017ee <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">\u0161est mjeseci<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">No, ukoliko je radnik odre\u0111eno razdoblje probnog rada <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">odsutan<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">, primjerice zbog bolovanja ili drugih prava, tada \u0107e mu se <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">probni rad produ\u017eiti onoliko koliko je bio odsutan<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> . <\/span><span style=\"vertical-align: inherit;\">Ovime \u0107e biti omogu\u0107eno da radnik ima dovoljno vremena dokazati se kao i da poslodavac ima vrijeme procijeniti sposobnosti radnika.<\/span><\/span><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Mogu\u0107nost zapo\u0161ljavanja na dodatnim poslovima<\/span><\/span><\/strong><\/h2>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Za <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">dodatni<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"><strong> rad<\/strong> radnik je morao\u00a0 <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">dobiti suglasnost od mati\u010dnog poslodavca<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> \u0161to \u0107e se novim Zakonom <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">promijeniti<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Naime, samo u <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">rijetkim slu\u010dajevima<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> \u0107e se mati\u010dni poslodavac <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">smjeti suprotstaviti radnikovom dodatnom poslu<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Ako je ugovor o radu za dodatni rad sklopljen na <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">\u010detiri mjeseca ili kra\u0107e<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> tada se broj radnih sati pove\u0107ava s <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">8 na 16 sati tjedno<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Ova promjena potaknut \u0107e radnike na dodatno zaposlenje i zaradu.<\/span><\/span><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Odsutnost s posla i nepla\u0107eni dopust za skrb o \u010dlanovima ku\u0107anstva<\/span><\/span><\/strong><\/h2>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Radnik bi prema jednoj potpuno novoj odredbi imao pravo na <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">izostanak s posla jednom godi\u0161nje bez posebnog opravdanja<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> i to na <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">tro\u0161ak poslodavca<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Radnik mo\u017ee iskoristiti i <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">nepla\u0107eni dopust za skrb o \u010dlanovima ku\u0107anstva<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Godi\u0161nje \u0107e se za takve potrebe mo\u0107i iskoristiti <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">pet radnih dana<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">.<\/span><\/span><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Rad od ku\u0107e \u2013 poslodavac \u0107e smjeti u\u0107i u ku\u0107anstvo zaposlenika<\/span><\/span><\/strong><\/h2>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Ukoliko radnik <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">radi od ku\u0107e<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> va\u017eno je spomenuti kako <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">\u0107e poslodavci smjeti ulaziti u ku\u0107anstva no pod odre\u0111enim uvjetima<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> koje \u0107e trebati dogovoriti. <\/span><span style=\"vertical-align: inherit;\">Time \u0107e se mo\u0107i dodatno kontrolirati uvjeti rada.<\/span><\/span><\/p>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Rad od ku\u0107e mo\u0107i \u0107e se ugovoriti kao <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">stalni ili povremeni<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">, a ako traje <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">du\u017ee od 15 dana u kontinuitetu<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\"> tada poslodavac treba odrediti i <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">iznos naknade re\u017eijskih tro\u0161kova.<\/span><\/span><\/strong><\/p>\n<h2><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Za radnike starije od 65 godina \u017eivota i 15 godina sta\u017ea nema otkaznog roka ni otpremnine<\/span><\/span><\/strong><\/h2>\n<p><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">Radnicima starijim od <\/span><\/span><strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">65 godina \u017eivota i 15 godina sta\u017ea <\/span><\/span><\/strong> <strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">ne\u0107e se morati isplatiti otpremnina niti \u0107e se morati odra\u0111ivati \u200b\u200botkazni rok<\/span><\/span><\/strong><span style=\"vertical-align: inherit;\"><span style=\"vertical-align: inherit;\">. <\/span><span style=\"vertical-align: inherit;\">Ova promjena trebala bi donijeti pobolj\u0161anje u segmentu zapo\u0161ljavanja starijih osoba.<\/span><\/span><\/p>\n<p><span style=\"vertical-align: inherit;\"><span
